Dear Mr. Vogel,
thank you very much for your reply and while I understand that you have
many things to sort out with the ZKM/WWP case I can not really accept
why the list of images and the names of the affected photographers and
also the usage period can not be delivered by 14th of June as requested
originally.
While I understand that you really have to think over the compensation
offer it is not clear for me what are the difficulties to make the
requested lists public.
The dates when you started / stopped using the images must be available
either electronically or on a hardcopy, the names of the photographers
whose images you used illegally must be known by ZKM.
Several of the photographers affected are contributors to our stock
photo library, WorldPanoramaStock and we have already contacted our
legal partner who practices primarily in intellectual property and
digital media law whose clients include stock photo libraries,
individual photographers which does not necessarily mean that we are
not open negotiate a solution out of court and based on mutual benefits.
Making the lists public is really not the legal part of the case.
It very much depends on your client's willingness to co-operate with
the affected WWP members and if ZKM does not deliver the lists by the
requested date, ie. tomorrow on the WWP Yahoo Group that would not
help to maintain a good working relationship for the future.
To sum up what has been set forth above, we would appreciate if the
requested list would be made public by tomorrow at the latest.
Thank you for your understanding and looking forward to your reply at
your earliest convenience.
Sincerely yours,
Tamas D.Varga
