Just adding a "TM" does not a TM make. TM's require registration and take
about 1-2 years to complete. If the phrase contains any other trade marked
terms, or the trade mark application description area contains TM'd phrases
the TM is denied.  I applied for a TM a couple of years back. In the
description I mentioned that it would be used on the "Internet." The
application was denied because the term "Internet" was trademarked.

If "High Def", "High Definition", "Virtual Tour" etc. is trademarked or
registered anywhere, the application would be denied.  I'd use it. If he
complains, ask for the Trade Mark registration certificate.

I own "Point. Click. Lose Weight." - I trade marked it for a project I was
working on a few years back. I do a search for the phrase every few weeks.
When I find it is use, I e-mail them a nice form letter - and offer to
license the TM to them.
