You can't (IMO), as long we are not in a collective agreement of recourse.
That very fact will be used against us letter by letter, i am sure.
A good start would be to get off this list to a temporary list with only
those interested in pursuing it further. Find a panel to give power of
attorney for initial negotiations based on the conditions of recourse
established. After that fails we could still decide to stay collective or
give it back to the individual to pursue.
It also might be be 'the' example to set for future recourse action as I
am sure this will not be the last as immersive media gets more popular.
