Think about those two sentences for a moment, please. It is quite
possible that the people involved did think that since the panos were
presented online it would honestly be okay to use them. That doesn't
make it any less wrong, but it should be something we allow for in
how we think about the actions by the individuals and the
organisation.
It seems that there has been a number of misunderstandings, including
the one that came out in the letter stating 'assumed consent'.
Perhaps that was an attempt to tidy up after the core mistake was
realised? Whether or not that's the case, even that shows a certain
flawed understanding of copyright...
Which does still indicate that there is at least some measure of
_mistake_ involved, not just _malice_.
I'm not excusing what was done; it was wrong and illegal. But I think
it is wise to remember that people do make mistakes (I'm sure we all
can remember far too many of our own), and that it is natural to try
to minimise the effects when things start to go wrong.
Something certainly does need to be done. But along with our search
for justice we should always remember humanity and perspective.
