One other thought that crosses my mind, as I was just up to The Getty
museum in LA this afternoon (where I worked until recently) - some
gardens may be considered works of art, and thus copyrighted. The
central garden at the Getty is, for instance - it was designed by
Robert Irwin and is an accessioned work of art in the Getty's
collection. As a general member of the public you shouldn't have any
problem photographing such a garden - but if it were a commercial
shoot it would be a different story. Many institutions assert
copyright control over images of their buildings, gardens and other
visual components of their site (since, for instance, The Getty's
architecture is iconic).
