While this is certainly an option, I urge you to view it as such for now.
I am positive there is room for diplomacy and negotiatons first.
Collecting all the facts first, openly and honestly.
Only desisting from such will and should lead to further action.
For your infomation: A class action suit can be very sucssessful and
expensive from both sides.
Depending on the factual case, some lawyers will take it on contingency
basis and take as much as 60/40 splits
on the projected damage. Either way, lets get the facts first.

I agree to pursue sensible alternatives first. I have proposed some in an
earlier mail and hope there will be some more.
Lets not spill all beans on this open list too much, everybody can listen
in. Can the list be locked for new members temporarily?
